Shipping policy

1. Welcome — how your order reaches you
Welcome to The Virtù Line. We work in close partnership with selected manufacturers and logistics providers who deliver your order to you precisely and safely. On this page you will find all important information on shipping, delivery times and costs.
These shipping terms apply to all orders placed via our online shop www.virtu-line.com and supplement our General Terms and Conditions. The shop is operated by Bodyfit Handels KG, registered office in Linz, Austria; The Virtù Line is a brand of Bodyfit Handels KG.

2. Delivery area
We deliver directly to Austria, Germany, Switzerland and Liechtenstein (mainland only in each case; island deliveries on request).
Customers from countries outside our delivery area can purchase our products on the same terms by providing a delivery address within our delivery area. Regardless of the specific shipping route, your contractual partner is always Bodyfit Handels KG.
Please note: deliveries to islands are possible on request – please contact us in advance.
Changes to the delivery area (e.g. in the event of countries joining or leaving the EU) will be published on our website and apply from the time of publication.

3. Delivery times
A binding maximum period applies to all products. The period begins when the contract is concluded – for payment in advance, when your payment is received – and applies to all countries in our delivery area (Austria, Germany, Switzerland, Liechtenstein):

Delivery within 12 weeks: all Pilates equipment and Pilates accessories, in all colours and versions (all colours are made to order).

If your equipment is ready for dispatch earlier, we will deliver correspondingly earlier. We will inform you of the exact delivery date within this period in our order confirmation; freight deliveries are also announced in advance (see section 12).

If a delivery is delayed
Should a delivery be delayed contrary to expectations, we will inform you without delay. Your statutory rights in the event of delayed delivery remain fully intact; in particular, you may withdraw from the contract in accordance with the statutory provisions. In this case, we will refund any payments already made without delay.

Note for business customers
Towards business customers, we reserve the right to withdraw from the contract if, despite having concluded a corresponding purchase contract, we are not supplied, or not properly supplied, by our supplier and this is not attributable to us (reservation of self-supply). In this case, we will refund any payments already made without delay.

4. Shipping costs
All shipping costs stated include statutory VAT unless expressly stated otherwise. The shipping costs are shown transparently during the ordering process before the order is completed.
Shipping costs at a glance
Shipping costs depend on the product category. The following flat rates apply per order:

- Reformers, Cadillacs, Halfcadillacs (complete): EUR 100.00
- Chairs, Ladder Barrels, Units, Pilates systems: EUR 45.00
- Halfcadillacs only: EUR 30.00
- Add-ons (Sitting Box, Arcs, Spine Corrector, Tower, Mat Conversion, Jumpboard and comparable add-on elements): EUR 19.90
- Pilates accessories, springs and other small items: EUR 9.90

For mixed orders containing items from several categories, the flat shipping rates are calculated separately for each category included and added together. The applicable shipping costs are shown transparently in the ordering process before the contract is concluded.
These flat rates apply regardless of the order value for the entire delivery area named in section 2.
Deliveries to Switzerland and Liechtenstein
Deliveries to Switzerland and Liechtenstein are also made at the same flat shipping rates (according to the table above). As these are deliveries to non-EU countries, however, the VAT applicable in the country of destination (Switzerland: MWST) as well as any import duties and customs fees are payable in addition. These charges are paid directly by the recipient to the competent authorities or to the carrier and are not included in our prices. We recommend finding out the expected amount in advance from the Swiss Federal Office for Customs and Border Security or from the Liechtenstein authorities.
Tax note
For deliveries within the EU to member states other than Austria, the local VAT applicable in the country of destination is charged. For deliveries to Switzerland and Liechtenstein, invoices are issued net; VAT is levied in the country of destination.

5. Shipping partners
Depending on the region and item, shipping is carried out directly by us or by our manufacturing partners. We use established shipping service providers, including:
- Österreichische Post AG
- DPD
- GLS
- Various freight forwarders for freight goods (Reformer, Halfcadillac, Cadillac, Wunda Chair, Ladder Barrel and comparable large equipment)

The specific shipping service provider is determined by us or by the respective manufacturer and may vary depending on the item and country of delivery. As soon as we have the shipping information, we will forward it to you by email.
For the delivery of your order, we pass on your name, your delivery address and, if applicable, your telephone number (for freight delivery notification) to the respective shipping service provider or manufacturer. Further information can be found in our privacy policy.

6. Transfer of risk
The time from which the risk of accidental loss or accidental deterioration of the goods passes to you depends on whether you order as a consumer (B2C) or as a business customer (B2B).
For consumers (B2C)
The risk of accidental loss and accidental deterioration of the goods only passes to you when the goods are handed over to you personally or to a person authorised to receive them whom you have named (§ 7b KSchG). This also applies if we have commissioned a carrier with the delivery – we as the seller bear the transport risk.
For business customers (B2B)
Towards business customers within the meaning of the Austrian Commercial Code (UGB), the risk of accidental loss and accidental deterioration of the goods passes to the buyer upon handover to the carrier (§ 429 ABGB). This applies to all shipping methods, including freight deliveries.

7. Shipment tracking
As shipping is carried out directly by us or by our manufacturing partners depending on the region, the availability of shipment tracking depends on the respective shipping partner. If we receive a tracking number, we will forward it to you by email without delay.
Please note: not all manufacturers and freight forwarders provide online shipment tracking. In these cases, we will inform you of the expected delivery time to the best of our knowledge.
If the tracking status of your shipment remains unchanged for several days or if you have not received any shipping information, please contact our customer service at info@bodyfit-shop.at or +43 5356 90990 – we will take care of it.

8. Partial deliveries
So that you receive your available items as quickly as possible, we reserve the right to ship your order in several partial deliveries. This may be the case in particular if individual items have different delivery times or are shipped by different manufacturers.
Partial deliveries do not incur any additional shipping costs for you – the flat shipping rate is charged only once per order, regardless of the number of partial deliveries.
You may refuse partial deliveries if they are unreasonable for you (§ 1415 ABGB).

9. Obstacles to delivery and force majeure
We are released from our obligation to deliver if and for as long as delivery becomes impossible or unreasonable due to circumstances of force majeure. Force majeure includes in particular natural disasters, epidemics, pandemics, war, terrorism, strikes, orders by authorities and other unforeseeable, unavoidable events beyond our control.

In the event of an obstacle to delivery, the following applies:
a) Notification: We will inform you without delay of the obstacle and the expected duration of the delay.
b) Extension of the period: The delivery period is extended by the duration of the obstacle.
c) Right of withdrawal: If the delay lasts longer than four weeks, both you and we are entitled to withdraw from the contract. In this case, any payments already made will be refunded to you in full without delay – at the latest within 14 days.
For consumers, the statutory rights of withdrawal in the event of delayed delivery (in particular under § 918 ABGB) remain unaffected. You may at any time set us a reasonable grace period and withdraw from the contract if it expires without success.

10. Acceptance and inspection of the shipment
Please inspect every shipment upon acceptance – ideally in the presence of the delivery person – for externally visible transport damage (damaged packaging, dents, moisture, etc.).
In the event of transport damage, we recommend:
a) Damage note: Have the delivery person note the damage on the delivery note, or refuse to accept shipments that are obviously severely damaged.
b) Photos: Document the damage with photos (packaging and contents).
c) Contact: Contact our customer service as soon as possible so that we can report the damage to the shipping service provider and arrange a quick replacement.
Note for consumers: Inspection upon acceptance is a recommendation – your statutory warranty rights remain fully intact even without immediate notification of damage. The reversal of the burden of proof under § 11 of the Austrian Consumer Warranty Act (VGG) (presumption that the defect already existed at the time of handover) applies for 12 months from handover.

11. Undeliverable shipments
If a shipment cannot be delivered – for example because acceptance is refused, the delivery address given is incorrect or incomplete, or the shipment is not collected within the storage period despite notification – the parcel is returned to the sender.
In this case, we reserve the right to charge the costs actually incurred for the return shipment if you are responsible for the failed delivery. We will contact you by email in advance and give you the opportunity to provide a correct delivery address or to arrange redelivery.
For consumers: If the failed delivery is due to a circumstance for which you are not responsible (e.g. an incorrect address entered by us), we will of course bear the costs of redelivery.

12. Freight goods – special features of Pilates and training equipment
Pilates reformers, Halfcadillacs, Cadillacs, Wunda Chairs, Ladder Barrels and other bulky or particularly heavy items (weighing 40 kg or more or measuring 220 cm or more in length) are delivered by freight forwarder. The applicable flat shipping rate is set out in section 4. Delivery is made to the kerbside. The following special features apply to freight goods:
Delivery appointment (notification)
The freight forwarder will contact you by telephone or email before delivery to arrange a delivery date. Please make sure that you can be reached at the telephone number provided.
Access and unloading point
As standard, delivery is made free kerbside (unloading point = the nearest point at the delivery address that can be reached by the delivery vehicle). Please note:
a) Access: Make sure that the delivery address is accessible for a delivery vehicle (truck).
b) Restrictions: Inform us in advance of any access restrictions (narrow roads, height restrictions, no turning space).
c) No carrying in: Carrying the goods into the flat, the basement or other rooms is not included in standard shipping. If you would like this service, please contact us in advance for an individual quote.

Customer's duty to cooperate
When accepting freight goods, we ask for your cooperation: please check the goods for visible transport damage and confirm receipt by signing the delivery note. Be sure to note any damage on the delivery note before you sign.
If a delivery fails due to a lack of cooperation (e.g. not being reachable despite notification, lack of access without prior information), the costs of a new delivery attempt may be passed on to you.

13. Return shipping costs
If you exercise your statutory right of withdrawal, you bear the direct costs of the return shipment. For defective or incorrectly delivered goods, we bear the costs of the return shipment. The expected costs are:

- For goods that can be sent by parcel (Pilates accessories, springs, small items, add-ons): approx. EUR 15 to 35 per parcel.
- For freight goods (Reformer, Halfcadillac, Cadillac, Chairs, Ladder Barrels and comparable equipment over 40 kg or 220 cm in length): at most EUR 650 per item for returns from Austria and Germany, at most EUR 1,100 per item for returns from Switzerland or Liechtenstein; we will be happy to tell you the exact costs in advance on request.
Returns from Switzerland or Liechtenstein to the EU may incur additional customs and handling fees.

This information is provided in accordance with § 4 FAGG before the contract is concluded.
You must organise the return shipment yourself, or we can coordinate it for you on request. Please contact us in advance at info@bodyfit-shop.at so that we can arrange the return shipment for you.
Note for consumers: In the case of defective goods or incorrect delivery, we will of course bear the costs of the return shipment. Your statutory warranty and withdrawal rights remain unaffected.

14. Note on deliveries and taxes
Our delivery area comprises Austria, Germany, Switzerland and Liechtenstein. We do not currently offer deliveries to other countries.
For deliveries within the EU to member states other than Austria, the local VAT applicable in the country of destination is charged. No customs duties or import charges apply, as this is intra-Community trade.
Deliveries to Switzerland and Liechtenstein are deliveries to non-EU countries. In this case, the VAT applicable in the country of destination as well as any import duties and customs fees are payable directly by the recipient to the competent authorities or to the carrier. These charges are not included in our prices.
Should we extend our delivery area to further countries in the future, we will inform you separately of any customs duties, import charges and additional taxes.
