Terms of service

General Terms and Conditions The Virtù Line
Version: 11 October 2026 (v6)

§ 1 Scope, contractual partner
These General Terms and Conditions (GTC) apply to all contracts concluded via the online shop www.virtu-line.com between Bodyfit Handels KG (hereinafter "we" or "seller") and the customer. A consumer within the meaning of these GTC is any natural person who concludes a legal transaction for purposes that are predominantly outside their trade, business or self-employed professional activity.

Seller: Bodyfit Handels KG, Wiener Straße 190, 4020 Linz, Austria, FN 576312v, Regional Court of Linz, VAT ID ATU78086615.

§ 2 Conclusion of the contract
The presentation of goods in the online shop does not constitute a binding offer but an invitation to the customer to submit an offer. The customer submits their offer by clicking the order button "Order with obligation to pay" ("Zahlungspflichtig bestellen"). The automatically generated acknowledgement of receipt does not yet constitute acceptance of the contract. The contract is only concluded when we accept your offer within five (5) days by means of an express order confirmation by email, by sending the goods or by requesting payment; in the order confirmation we will inform you of the delivery date. When paying by card or via an online payment service, the amount is initially only reserved (authorised) when the order is submitted. It is only debited when we accept your offer with the order confirmation. If no contract is concluded, we release the reservation – nothing is debited.

§ 3 Prices and shipping costs
All prices are in euros including statutory VAT and plus shipping costs. Shipping costs are shown separately during the ordering process and can be viewed on the shipping information page.

§ 4 Payment
We accept the following means of payment:

- Credit cards (Visa, Mastercard, American Express, Maestro, UnionPay), Apple Pay, Google Pay and Shop Pay via Shopify Payments
- PayPal
- Klarna
- Payment in advance / bank transfer to our business account at Raiffeisenlandesbank Oberösterreich AG

In certain countries, local payment methods are also offered (e.g. EPS in Austria). The payment methods available in each individual case are shown in the ordering process.

The purchase price is due for payment upon conclusion of the contract unless otherwise provided for the selected means of payment. For payment in advance, the payment period is 7 working days from the order date. For self-collection, § 5a (8) applies.

§ 5 Delivery, delivery time, retention of title
We deliver to Austria, Germany, Switzerland and Liechtenstein. Customers from countries outside our delivery area can purchase the goods on the same terms by providing a delivery address within our delivery area.

Delivery is made within 12 weeks of conclusion of the contract or, for payment in advance, of receipt of payment; this applies to all products, colours and versions and to all countries in our delivery area. If the goods are ready for dispatch earlier, we will deliver correspondingly earlier. We will inform you of the exact delivery date in the order confirmation.

The goods remain our property until paid for in full. If the customer is a consumer, goods are shipped at our risk.

§ 5a Self-collection (Click & Collect)
(1) Option of self-collection. If offered and selected as the delivery method in the ordering process, you can collect your order yourself at our registered office at Wiener Straße 190, 4020 Linz. The current opening hours can be found on our website. No shipping costs are charged for self-collection.

(2) Notice of availability. As soon as your order is ready for collection, we will inform you by email (notice of availability). Collection is only possible after receipt of this notice.

(3) Identification upon collection. The goods are handed over only upon presentation of the notice of availability (digital or printed) and an official photo ID (passport, identity card or driving licence). This procedure serves solely to protect your order against unauthorised access. Your ID data is not stored or copied; the visual check is based on Art. 6(1)(f) GDPR. Further information can be found in our privacy policy.

(4) Collection by third parties. If you cannot collect your order in person, it can be handed over to a third party only upon presentation of a written power of attorney signed by you and the photo IDs of both the purchaser and the authorised person. We reserve the right to refuse handover if there are justified doubts about the identity or authorisation.

(5) Holding period. We will hold your order ready for collection free of charge for 14 calendar days from receipt of the notice of availability.

(6) Storage fee. If the order is not collected within the period under paragraph (5), we are entitled, after setting a reasonable grace period of at least seven calendar days, to charge a storage fee of EUR 5.00 per storage day or part thereof, capped at EUR 100.00 per order. The amount of the storage fee is based on the costs actually incurred for storage space, insurance and administrative effort and does not constitute a contractual penalty.

(7) Withdrawal from the contract. If the goods are not collected within the grace period set under paragraph (6), we are entitled to withdraw from the purchase contract in accordance with § 918 ABGB. Payments already made will be refunded to you less the storage fee incurred up to the withdrawal. The refund is made via the means of payment originally used.

(8) Payment. For self-collection, payment in advance applies unless expressly agreed otherwise. Should a remaining amount exceptionally be payable upon collection, we will point this out separately in the notice of availability and state the accepted means of payment.

(9) Transfer of risk. For self-collection, the risk of accidental loss and accidental deterioration of the goods passes to you upon handover to you or to the person authorised by you. The provisions of § 5 of these GTC on the transfer of risk for shipped goods do not apply in this case.

(10) Right of withdrawal. Your right of withdrawal under the Austrian Distance and Off-Premises Contracts Act (FAGG) remains unaffected by the choice of self-collection as the delivery method. The withdrawal period begins when you or the person authorised by you take possession of the goods. Information on the right of withdrawal can be found in our withdrawal policy in accordance with Annex I lit. A FAGG.

§ 6 Warranty
The statutory warranty provisions apply. For consumers, the Austrian Consumer Warranty Act (VGG) applies; for businesses, Sections 922 et seq. of the Austrian Civil Code (ABGB). Consumers are entitled to warranty for a period of two years from handover of the goods. In the event of a defect, the customer may demand repair, replacement, an appropriate price reduction or termination of the contract, subject to the statutory requirements.

If the goods are repaired under warranty within the warranty period, the warranty period for these goods is extended once by one year. This applies to contracts concluded on or after 1 October 2026.

For digital services and smart products, we provide the necessary updates during the statutory period (update obligation under § 7 VGG).

§ 7 Right of withdrawal for consumers
Consumers have a statutory right of withdrawal. Details can be found in the withdrawal policy.

§ 8 Liability
We are liable without limitation for intent and gross negligence, under the Product Liability Act and for damage resulting from injury to life, body or health. In the case of slight negligence, we are liable only for breach of essential contractual obligations and limited in amount to the foreseeable damage typical for the contract.

§ 9 Notes on safe use
Our equipment is high-quality training equipment that requires professional assembly and use. Observe the operating instructions supplied as well as the spatial and structural requirements (ceiling height, load-bearing capacity of the floor). The equipment may only be used by persons who have been instructed in its use. If in doubt, we recommend instruction by a qualified trainer.

§ 10 Consumer dispute resolution
The European Commission's online dispute resolution platform (ODR platform) was discontinued with effect from 20 July 2025 pursuant to Regulation (EU) 2024/3228. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

§ 11 Applicable law and place of jurisdiction
Austrian law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods. For consumers, mandatory provisions of the Austrian Consumer Protection Act (KSchG) and mandatory provisions of the law of the consumer's habitual residence remain unaffected. The place of jurisdiction for disputes with business customers is the competent court in Linz.

§ 12 Final provisions
Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions remains unaffected.
